Historical cases in Indecopi are in danger with the endorsement of the PCM

For the specialist, that Karin Cáceres, former secretary of Prime Minister Otárola, has demanded this Monday the resignation of more than 40 officials, including directors and technical secretaries, represents an attack against the institutional framework, since it suppresses personnel who saw cases such as the Club de la Construction and the dominant position of Gloria.

Thus, the investigator anticipates a possible takeover by a sector of the industry and the political class.

Although in itself the selection of high positions in Indecopi was never good, he refers, on this occasion the governing principles in the regulatory bodies were “arbitrarily” ignored.

“OECD, to which we aspire, has been recommending an improvement in our selection mechanisms for years. Unfortunately, the governments do not take care and the appointments are by finger. They are destroying the little progress we have made in institutional matters,” he blurts out.

But it is not an exclusive practice of Indecopi. For example, Távara explains that, with Petroperú, the Executive published a regulation in the budget law to expedite, again, the removal of directors, “something that violates all the principles of corporate governance that work well in other countries.”

Returning to the case of Indecopi, executing so many changes in key positions risks the possible delay of some emblematic processes, which could even prescribe, in the opinion of Santiago Dávila, former general manager of the regulatory body.

Besides of construction club, there is the settlement of natural gas for vehicles (not yet resolved in the second instance), the restructuring of soccer clubs, ongoing investigations into the means of payment with credit cards, vacillations in the hydrocarbons market, as well as other protection issues to the consumer that Indecopi is currently investigating.

“We can’t go on like this. Until these people learn what they are going to do with those pending cases, some prescribe. So who wins with these types of reforms?” he said.

Dávila explains that there are already real reform proposals for Indecopi, among which are giving it constitutional rank —like the BCRP— or that the Board of Directors be appointed as is done in public service regulatory bodies.

That is, there is a nomination of candidates who meet the profile. But it all depends on Congress. At this point, he questions involving the participation of the Comptroller.

“Controllership should now be auditing the entire issue of Reconstruction with Changes, the Ministry of Housing, MTC, which are sources of corruption in public works where the entire State budget goes. Indecopi’s budget is extremely limited. How are you going to divert resources and attention to reviewing these issues? It doesn’t make sense,” he says.
