FOSE Law: stratification of households for subsidy is suspended until further report from INEI

The Peruvian Government promulgated today, March 21, 2023, the Law No. 31713, suspending the application of article 3-A of the Law No. 27510, that creates the Electric Social Compensation Fund (FOSE), which had previously been approved by the Congress of the Republic, with the objective of correcting the distortions in the electricity rates generated.

At the beginning of March, the Plenary Session of Congress approved, by a large majority, the opinion that proposes suspending the application of this article that established criteria for the exclusion of users of the electricity service located in blocks classified as high and medium-high strata, according to the plan available stratified by blocks from the National Institute of Statistics and Informatics (INEI).

According to the explanatory statement, thousands of low-income people would be harmed by the collection of high electricity rates, due to an “outdated” report from INEI related to the socioeconomic situation of users.

Congressman Jorge Flores Ancachi, author of the law, regretted that, despite technological and digital advances, it is not possible to have clear, accurate and reliable information for the efficient application of public subsidy policies.

The suspension of this application will be until the INEI issues a new technical report on socioeconomic stratification at the national level, which will be supervised by the Supervisory Agency for Investment in Energy and Mining (Osinergmin).
