If you are tired of receiving innumerable daily phone calls in which they offer you services, products or on many occasions no one responds; You should know that you can report this situation to the National Institute for the Defense of Competition and the Protection of Intellectual Property (Indecopi). Below, we share the details about it.

Where can I report phone harassment?

He indecopi has channels through which citizens can make their claims and register the spam calls and other non-compliances of the companies through the Sub-directorate of Attention to the Citizen or by filling out the form “Citizen surveillance” which is available in the section “Online services” from your website. It is worth mentioning that this means is only to report the problem to said entity, but not to initiate a sanction process.

What steps to follow to register my claim?

  • People who insistently receive calls, emails or messages can make their virtual report at the following LINK, in which they must write the problem, the reason for the complaint, the date, request and the Indecopi office that will manage the claim .
  • After that, they will obtain the claim number and the name of the official in charge.
  • The case will be transferred to the provider and a solution will be sought through mediation or conciliation.
  • Another option is to report the complaint to the mail sacreclamo@indecopi.gob.pe or to the phones 224-7777 (Lima) and to 0800-4-4040 (regions).
  • If the spam calls do not come from a recognized company, you can block these numbers or install an application to filter this type of communication.

What else can I do to avoid spam calls?

  • File a complaint in the complaints book, in which the provider will have a period of 15 business days to access the request and end persistent communications.
  • Start the procedure to exercise the right of opposition, in which the company will have 10 business days to access the request.
  • File a complaint with the Indecopi Consumer Protection and Defense Commission, stating that the provider has made offers without the consent of the consumer.
  • File an administrative complaint with the Personal Data Protection Department, arguing that the company made the offer without the client’s consent.

What are the sanctions against companies that commit telephone harassment?

Companies that offer products or services through aggressive trading methods such as phone calls, emails or instant messages, can be fined up to 450 ITU, according to the Consumer Protection and Defense Code.
