The Specialized Room in Elimination of Bureaucratic Barriers of Indecopi (SEL), through Resolution 0072-2023/SEL-INDECOPI, decided to suspend, this Monday, March 6, the main procedure related to measures that prohibit labor outsourcing. This applies to activities that are part of the core of a company until the popular action processes filed before the Judiciary are resolved.
It should be noted that the precautionary measures ordered in Resolution 0355-2022/SEL-INDECOPI of September 30, 2022 remain in force and effective.
Indecopi made the decision because various companies have filed popular action lawsuits before the Judiciary (File 756-2022-0-1801-SP-DC-03) against Supreme Decree 001-2022-TR, which provides for the prohibition of labor outsourcing and that has not yet been resolved.
Therefore, in accordance with the provisions of article 13 of the Consolidated Text of the Organic Law of the Judiciary, in accordance with the provisions of paragraph 2 of article 31 of Legislative Decree 1256, Law for the Prevention and Elimination of Bureaucratic Barriers and Article 65 of Legislative Decree 807, Law on Indecopi Powers, Regulations and Organization, the Chamber ordered the suspension of the procedure.
Likewise, it is specified that this is not a pronouncement on the merits of the denounced controversy, but only suspends the process of eliminating bureaucratic barriers until the Judiciary issues a final sentence.
