The Government promulgated the law that declares November 5 of each year as a non-working holiday, as stated in the Bulletin of Legal Regulations of the official newspaper El Peruano of March 4. On that date is celebrated Municipal Worker’s Day in recognition and gratitude for his work for the benefit of the society.
Let us remember that, on September 15, 2022, the plenary session of Congress approved, in the first vote, the bill, in charge of the legislator Isabel Cortez, which proposed declaring said day of each year as a non-working holiday for these workers. The initiative was endorsed in a second process by reaching 93 votes in favor.
New non-working holiday: who benefits?
The Law 31701 provides that the non-working holiday of November 5 will benefit the workers who carry out said responsibility in various municipalities of the country.
According to the legal provision, the day will be paid and considered as worked. The measure will reach 7,000 municipal workers throughout the country and has as its purpose of making visible and recognizing the importance of these employees in the various areas of its function.
How was born the Day of the Municipal Worker?
Municipal Worker’s Day was given as a result of a manifestation in 1979 it lasted around 62 days. The municipal workers complied with a national indefinite strike for a list of demands to the government of Francisco Morales Bermudez. At that time, local governments depended on the Ministry of the Interior.
On the afternoon of November 5, at around 4 pm, the then president met with a commission of strikers in the Government Palace, where it was possible to sign agreements to resolve the measure that had exceeded two months.
How much should I get paid if I work on a holiday?
If an employee works during a holiday and without a substitute rest day, they are entitled to a triple remunerationwhich consists of the payment for the work done during that day, an amount for doing it on a holiday and an additional balance equivalent to 100% of the daily salary (surcharge).
