Government orders the non-application of safeguards for the importation of Chinese clothing

Indecopi’s report, adopted by MEF, Mincetur and Produce, resolves that it is not possible to conclude that the domestic industry has experienced serious damage due to imports of clothing in the period January 2016 – June 2021.

The Peruvian Government decided not to apply the definitive safeguard measure on imports of clothing China.

Through Supreme Decree 002-2023-MINCETUR, the Ministry of Foreign Trade and Tourism (Mincetur) stated that, according to the report of the Indecopi Commission on Dumping, Subsidies and Elimination of Non-Tariff Trade Barriers, “it is not possible to conclude that the domestic industry has experienced serious injury due to apparel imports in the period January 2016 – June 2021”, based on the information and evidence collected.

“That being the case, it recommends that the investigation procedure be terminated without recommending the application of definitive safeguard measures on the investigated imports”upholds the decree.

In this way, the Multisectoral Commission — made up of the Ministers of Economy and Finance, Foreign Trade and Tourism, and Production — concluded that Report No. 042-2022/CDB-INDECOPI does not allow the necessary requirements to be accredited for the application of safeguard measures. on imports of apparel because “it has not taken into account the breadth and heterogeneity of the investigated product”.

In addition, it considers that the existence of a group of tariff subheadings that do not present an increase in such quantity and conditions such as to cause serious damage to the domestic industry was not taken into account; and the absence of serious damage, as established in the Agreement on Safeguards of the World Trade Organization (WTO).

Previously, Minister Alex Contreras had anticipated that the safeguards “would represent a danger” for mypes because they would bring harmful “retaliatory measures” towards the local industry, that is, China could raise tariff rates for products we export to them.
