Pregnant and lactating workers on probation are protected against redundancy

The Ministry of Labor and Employment Promotion (MTPE) emphasizes that, according to Law 31152, pregnant and lactating workers who are on probation or who complete a part-time workday of four or less hours a day, are also protected against nullification.

Thus, they emphasize that any dismissal suffered by the mother during the time of gestation or within the first ninety days after the birth of the child, as well as on the occasion of breastfeeding, is considered null and void, as long as the employer does not prove the existence of just cause to apply that measure.

This measure is derived from the obligation of the State, employers and society to protect pregnant and lactating workers, as well as the newborn, recognizing that pregnancy, lactation and the life of a boy or a girl fulfill a social function. that allows us to strengthen ourselves as a group and that in this context it is relevant to guarantee equal opportunities in the workplace.
