Congress asks that a specific bill be sent to be analyzed with all the groups involved. Faculties were only granted in 33 points of the 42 requested by the Government.
With 14 votes in favour, 2 against and 2 abstentions, the Economy Commission The Congress of the Republic approved the ruling that delegates to the Executive Branch the power to legislate in matters of economic reactivation and modernization of State management with adequate standards of suitability and meritocracy in public administration. It also had the approval of the Decentralization Commission.
The text approved by both working groups and which must now be debated in the plenary session of the Congress of the republic does not include all the requests of the Executive Power, since Of the 42 powers requested, they are being authorized the power to legislate on 33 issues.
“Regarding the tax, there are eight points, we are giving them powers in six, two are the ones that have been observed so as not to give them and obviously with the charge that they (the Government) present a legislative initiative, which will enter the the commission, and that we will finally be able to debate to involve the unions. In the totality of 42 points, we are giving powers to 33, which represents approximately 79% of all the projects that have been presented.“, explained Rosangella Barbarán, president of the Economic Commission.
Tax simplification is not going
One of the most ambitious requests from the Executive Branch was the simplification of the tax regime, however, this proposal did not prosper and was rejected by both commissions, which argued that the arguments were not very solid, and also asked the Government to present a bill specific to pass the regular process.
“Regarding tax measures, the creation of a simplified income tax regime for mypes, based on existing systems: new single simplified regime, tax and special income mype, which seems to us an important initiative but whose The proposal lacked sufficient support and, furthermore, it has been considered that the most convenient thing would be for the Executive Branch to issue a bill to the Congress of the republic in order to promote a broad debate on the subject, summoning the representatives of the target groups of the standard, the mypes. This is also considering that a law like this cannot yet be implemented as of 2024,” Barbarán pointed out.
It is worth mentioning that the proposal of the Ministry of Economy and Finance (MEF) was to reduce from four to two tax regimes.
Currently, Peru has four regimes: the General Regime; Single Simplified Regime (RUS); Special Income Regime (RER) and the Mype Tax Regime (RMT). However, the MEF proposed repealing these last two so that the tax scheme is simpler and more orderly.
