The worker, an orderly at a health center, suffers from various symptoms that are “incompatible with work performance.” The case was brought to court by the ELA union. The sentence allows to claim compensation.
The Social Court number 2 of Bilbao has recognized a Absolute permanent disability derived from work accident to an orderly, a health center worker, who was diagnosed with persistent Covid. The ELA union took the case to the courts, which, finally, sided with the worker.
This guard suffered a coronavirus infection in March 2020. Subsequently, he was diagnosed with Long or Persistent Covid, Post-Covid Chronic Fatigue Syndrome, severe depressive syndrome reactive to persistent Covid, and moderate cognitive impairment.
As a consequence of the pathology, the worker suffers fatigue, dizziness, instability, insomnia, mental fog and tachycardia, as well as cognitive deterioration that affects concentrated and sustained attention, processing speed and working memory. All this is “incompatible with job performance”, according to what is reported in the note published by the ELA union.
ELA has been very satisfied with the sentence because “it recognizes the pathology of the Permanent Covid that has left many workers with serious consequences”. Likewise, it has reported that the resolution allows the Bidelagun Foundation, ELA’s occupational health foundation, to request a surcharge for benefits for non-compliance with compensation and preventive measures by the company.
In fact, according to the union, “the personnel who worked in the first wave of the pandemic acted without adequate protection measures.”
