According to Supervisory Agency for Private Investment in Telecommunications (Osiptel), Telefónica del Perú is the company most fined in Peru in the last five years. In addition, it accumulates sanctions of more than S/157 million for committing various violations of legal regulations and contractual obligations that the operating companies must comply with.
Along these lines, the fines against Telefónica totaled S/377.55 million, representing 41.71% of the sanctions applied to all operating companies in the last five years. Meanwhile, the fines applied to Claro amount to S/72.20 million, followed by Entel with S/65.05 million, Bitel S/54.36 million and other operating companies accumulate S/28.48 million, in sanctions and together represented 58.29%.
Telefónica the most fined during 2022
During 2022, Osiptel imposed sanctions for a total of S/87.60 million (19,044 UIT), to companies that operate fixed and mobile telephony, pay television and internet services.
In that year, Telefónica del Perú was also the company that accumulated the highest fine imposed with respect to the rest of the operators and reached S/43 million (9348.33 UIT). It is followed by Entel with S/16.55 million. Both companies concentrated 68% of the total penalties. The remaining 32% corresponds to sanctions against Claro (S/11.73 million), Bitel (S/9.08 million) and other companies (S/7.25 million).
It should be noted that most of the fines were due to the misconduct of the operating companies regarding the interruption and availability of the service. For this irregularity, he was fined an amount of S/17.73 million. Likewise, there were also sanctions for the delivery of information to Osiptel (S/16.62 million), stolen terminals (S/11.54 million), quality indicators (S/9.53 million), improvement commitments (S/ 8.56 million), returns (S/4.75 million), street sales (S/ 4.61 million), among others.
Breaches by operating company
Finally, Telefónica maintains the highest penalty for not complying with the obligations derived from the regulations on interruptions and availability of the service (S/16.43 million).
Likewise, it has a penalty of S/6.86 million for non-delivery of information to Osiptel.
It is followed by Entel, with a fine of S/4.86 million, also corresponding to non-compliance in the delivery of information to Osiptel and for irregularities in portability (S/3.15 million). For its part, Claro was penalized for issues related to stolen terminals-RENTESEG for S/4.23 million; Bitel was fined for not complying with quality indicators and totaled S/5.55 million.
