The Supreme Court recently issued a ruling urging Telefónica del Perú to pay around S/ 3,000 million to the State after resolving a dispute with Sunat over differences in the Income tax (IR) from the years 2000 and 2001.
In this regard, the telecommunications company argued that the resolution of the Supreme Court does not contain any payment mandate, while those issued in contentious-administrative proceedings resolve on concepts derived from a pronouncement of the Tax Court, and, therefore, do not contain a payment obligation.
The document — submitted to the Superintendency of the Stock Market (SMV) — states that Once these processes are completed, the Sunat, through an administrative act, will determine the mandatory amount to be paid.
“Notwithstanding the fact that Sunat has made an estimate public, it is pending the issuance of the corresponding administrative act,” they added.
