Executive published list of inputs that will access tax credit for VAT exemption

A few hours after Law No. 31452 came into force, the Ministry of Economy and Finance (FEM) published this Saturday, April 30, the list of supplies that will access a tax credit for exemption from the general sales tax (VAT) to the products to which the discount will be applied from May 1 to July 31, 2022.

Thus, in accordance with Supreme Decree No. 083-2022-EF published in A Peruvian man and which bears the signature of Minister Óscar Graham, starting tomorrow, fresh, chilled or frozen poultry meat of the Gallus domesticus species; fresh chicken eggs of the species Gallus domesticus; the sugar; uncooked, stuffed or otherwise prepared pasta; and the bread will not pay said contribution.

As you remember, the unions claimed that it was useless to exonerate the IGV if in the production process they still had to cover certain costs; therefore, the MEF clarified that they would publish this list of main inputs (of those already exempted foods) to access the tax credit.

The regulations also state that taxpayers who market the exempted goods may apply the General Sales Tax as a fiscal credit corresponding to the acquisitions or imports of the goods indicated in the previous paragraph required in the production process of the exempted goods.

Likewise, the indicated sales operations are not considered as non-taxed operations for purposes of calculating the pro rata tax credit.

In addition, the document specifies, as a final complementary provision, that the National Superintendency of Customs and Tax Administration (Sunat) will establish the extra regulations that are necessary for the best application of what is stipulated.
