Congress: Commission approves ruling to ban spam calls

The Consumer Defense Commission of the Congress of the Republic unanimously approved the ruling to prohibit the spam calls. This initiative groups three proposals, one of the authors is the legislator Katy Ugarte, from the Magisterial Block of National Coordination, who pointed out that it also seeks to protect the personal data of citizens and improve the suitability of customer services.

In the opinion handed down in the draft Law No. 2942/2022-CR, 3131/2022-CR and 3541/2022-CR which, with a substitute text, proposes to modify Law 29571, Consumer Defense Protection Code, expanding the prohibition of spam calls for being aggressive or deceptive commercial methods and that can affect the freedom of choice of the consumer through harassment, coercion, undue influence or fraud. In addition to Ugarte, the other authors of the initiative are Patricia Juárez and José Luna.

Peru ranked second worldwide in countries with the highest number of unwanted calls or spam, according to the Truecaller Insights 2021 report. Brazil is the only country that is above Peru and below are countries such as Ukraine, India, Mexico, Indonesia, Chile, Vietnam, South Africa, Russia, Colombia, among others. In 2020 our country came to occupy the fourteenth position in the world ranking; however, in 2021, it returned to second place.

“Consumers in this country receive calls every day for advertising, commercial and collection purposes, even if the payment term has not expired, causing discomfort in people without respecting schedules, work or rest moments. On the other hand, when a call is made to present a claim or doubt from a client, robotic machines answer, spending a long time without having a personalized call, ”said Ugarte in his intervention.
