The Internal Revenue Service (SRI) set for the first semester of 2023 (between January and June) the value that those who deliver the recycled bottles will receive to bottlers, importers, recyclers and collection centers.
According to the director of the Internal Revenue Service, Francisco Briones, with the decision the conversion factor of plastic bottles is increased: “With this decision we promote the recycling of plastics, we boost the economy of hundreds of thousands of recyclers and we boost the industry drinks,” he said.
The Law for Environmental Promotion and Optimization of State Income, published in the Supplement to the Official Gazette No. 583 of November 24, 2011, created the Redeemable Tax on Non-Returnable Plastic Bottles. The tax allows a value to be delivered to whoever collects, delivers and returns the bottles, based on the respective collection mechanisms, both for the public and private sectors, as provided in the regulation
Currently the return value is 2 cents per bottle, but there is a formula to calculate the value to be returned for the bottles, when the exact number of bottles collected cannot be determined. The formula is KBP*M. Where KBP is equal to the number of kilograms of plastic bottles recovered; and M is the dollar amount per kilogram of plastic bottles. The M value must be set every six months by the SRI through the resolution.
Thus, according Resolution NAC-DGERCGC22-00000057 of December 22, the SRI set the price at $0.46 per kilogram, considering that one kilogram would have about 23 bottles. The value changes with respect to the previous resolution that governed the period from July 2022 to December 2022 and which was 0.30 per kilo considering that one kilo is made up of 15 bottles.
The recycling process continues, despite the fact that by means of judgment no. 58-11-IN/22, of January 12, 2022, within case no. 58-11-IN and accumulated, the full Court Constitutional Court of Ecuador resolved to determine the unconstitutionality of the Law for Environmental Promotion and Optimization of State Income. Despite this, the law remains in force, since the Court itself, “in order to avoid a serious regulatory vacuum in tax matters and to guarantee legal certainty, the effects of said sentence are deferred until the end of fiscal year 2023 (31 December). December 2023)”.
In Ecuador and worldwide, ways to recycle plastic are sought, so it is transformed into bottles, clothing, construction material, among others.
Between January and November 2022, the SRI had a gross collection of about $15.700 million. This figure meant 24% growth, compared to the previous year in which between January and November 2021, 12,700 million were raised. The entity has clarified that this 24% growth is due to 17.6 percentage points to the reactivation and 6.4 points to the new tax law.
Regarding the tax for the promotion of the environment, $44.3 million was collected. Instead, only for the redeemable tax on plastic bottles was obtained $35.8 million, which is a figure well above the goal set, which was $20.8 million. (YO)
