The Ministry of Economy and Finance (MEF) has been preparing its tax agenda for 2023. And, although they have already ruled out tax increasesthey do seek to simplify the regimes that Peru currently has.
Thus, in dialogue with La República, the head of the MEF, Alex Contreras, announced that they are working on a bill so that there are no longer four tax regimes in Peru, but only two: the general regime and that of the mypes.
“That is what we want to do in 2023. Simplify the regimen basically to just two: a general regimen and a very specific regimen limited to very small businesses; added to a whole strategy that has to come from the side of Sunat so that the implementation of this is quick, ”Contreras Miranda explained to this medium.
It is important to mention that Peru currently has four tax regimes: the General Regime, the New Single Simplified Regime (NRUS), the Special Income Tax Regime (RER) and the MYPE Tax Regime (RMT) (see infographic).
Topic on the agenda
Vanessa Watanabe, partner of Estudio Payet, Rey, Cauvi, Pérez Abogados, indicates that it is not the first time that a Minister of Economy has put the simplification of tax regimes on the agenda; however, she considers that, since this issue has already been discussed before, said proposal could materialize.
The expert agreed with what was raised by Minister Contreras because it points to more mypes being able to formalize with a more accessible regime. However, she suggests that this proposal should be accompanied by business training.
For his part, the tax lawyer Miguel Carrillo mentions that this would be the second time that he proposes to maintain only two regimes, since in the management of Pedro Francke the powers to legislate on this issue were requested, which was finally denied.
Likewise, for the expert, only the RER, since it is the one that is having the least impact; while the general regime and the mype are the ones that contribute the most to the collection.
“If the idea is to disappear a regime, it could be the RER since it does not generate much collection because it is 1.5% per month, they do not submit an annual sworn statement and have a ceiling of S/525,000″, adds Carrillo.
Ease for mypes
The Minister of Economy also indicated that his administration will seek to encourage mypes to formalize by facilitating their taxation process.
In addition, he explained that it will seek to move from a fixed payment scheme to one based on income, something that would generate incentives for companies to declare costs, which is not currently available.
Will platforms pay IGV?
The owner of the MEF He also indicated that the necessary information is not yet available to implement a mechanism that allows digital platforms such as Netflix, Disney, among others, to pay the IGV in our country. However, he specified that this year work will continue in this aspect, hand in hand with the World Bank.
“In the case of digital platforms we still do not have enough information, we have space to work also in 2023; Right now there are some support consultancies from the World Bank to precisely see the best way,” Contreras added to La República.
