Christmas bonus: how much is the fine for companies that do not pay on time?

The formal workers from the private sector are entitled to receive the 2022 bonus in National Holidays and Christmas. This benefit, recognized in Law No. 27735, is valid for all types of employment contract, even for those who work part-time.

The National Superintendence of Labor Inspection (Sunafil) specified that not paying the gratuity in full and on time constitutes a Serious offense in labor material. In this sense, a company that does not comply with granting it could receive a fine between S/ 20,700 (mypes) and S/ 120,152 (non-mypes).

Between July 2021 and the same month in 2022, Sunafil issued 4,061 fine resolutionsbetween first and second instance, for a total amount of S/ 21,681,263 for violations related to the payment of gratification. The superintendency stressed that the employer must disburse a bonus of 9% (isHealth) or 6.75% (health provider company, EPS) along with the assignment, as appropriate.

Until when is there a term to deposit the gratuity?

The deadline to disburse the Christmas bonus expires this December 15. This payment will not be affected by contributions, contributions or discounts of any kind, except those established by law or authorized by the worker.

In the event that an employee has ceased their work in the company, they are entitled to a truncated gratification, as long as you have worked for at least one calendar month in the current semester. The calculation will be proportional to the time worked and is canceled along with the other benefits after 48 hours of separation.

How much should they pay you for gratuity?

You need to take as a base your remuneration in effect by November 30 to calculate the gratification. The delivery of this benefit will be equivalent to the salary plus the family allowance (if applicable). Workers affiliated with EsSalud receive an additional 9% and those attached to an EPS increase 6.75%.
