Workers give the Superintendency of Banks a term to appoint their delegate to the IESS, protected by decree 571

Leaders of the historical trade union centrals ordered this November 9 the Superintendency of Banks to pronounce itself and appoint the vocal representative of the workers before the Board of Directors of the Ecuadorian Social Security Institute (IESS). In this way, they gave him until Friday to appoint the new member, otherwise they will carry out mobilizations to demand speed from the control body.

This, in the midst of the process of renewal of members of the Board of Directors that is carried out after the issuance of the Presidential Decree 571 of last October 3, with which the President of the Republic, Guillermo Lasso, proceeded to give a legal solution to the formation of the Council, whose members representing employers (César Rodríguez) and workers (Luis Clavijo) had extended functions and more than ten years in office.

The renewal of members does not seem to have an easy way out considering that the National Assembly approved a few days ago a law that regulates the election of members and that could contradict the process that is protected by the presidential decree. Thus, the Superintendency has been left without a course of action, while the IESS fails to form its Board of Directors and remains without its governing body.

Thus, this morning, Margoth Corrales, president of the Single Federation of Peasant Social Security Affiliates (Feunassc); José Chusic, leader of the General Union of Workers of Ecuador (UGTE); Nelson Erazo, from the Popular Front; Isabel Vargas, president of the National Union of Educators (UNE); Fernando Ibarra, from the Labor Parliament; and, Patricio Cedocclat, who with other additional organizations support the candidacy of Ramiro García and Ramiro Beltrán as main and substitute member, made the pronouncement.

Fernando Ibarra explained that the position of the workers is that if by Friday the member of the workers has not been sworn in, they will proceed with mobilizations. Additionally, he commented that it has been unofficially known that the IESS would be seeking to convene Council meetings with only two members, the employers’ spokesperson María de los Ángeles Rodríguez, already appointed by the Superintendency, and President Alfredo Ortega. Or it has even been known that the current representative of the workers, Luis Clavijo, has requested to rejoin the Council. Neither of the two options would be legally viable, because Decree 571 ordered the renewal of both vowels, he said.

Ibarra commented that the Superintendency is not acting with the same speed with which it acted when dealing with the issue of employers. And regarding the existence of two candidates: Ramiro García and Richard Gómez for the workers’ committee, he said that what corresponds to the Superintendency is to verify which of the candidates has the most votes from the duly accredited voters, and appoint him.

In any case, he explained that in light of the facts From now on, the workers have sought to manage that the superintendent, as well as the Minister of Labor and the Attorney General, respond on the role they have played both in the issue of social security and in other labor matters. Therefore, in a few days will be summoned to the Assembly, through Assemblywoman Sofía Espín.

For Ibarra, andhe fact that the Assembly has recently approved a rule on the election process for members does not dismiss the decree process, since the members now designated will be in office until the National Electoral Council manages to carry out the process, which could take several months.

Meanwhile, yesterday it was learned that there is no certainty about the situation of the employers’ spokesperson. On the one hand, the IESS authorities They have banned César Rodríguez from entering the entity, who would have been replaced by María de los Ángeles Rodríguez. However, the situation of María Rodríguez is also uncertain, since her appointment was challenged by an organization of popular and solidarity economy companies and retirees.

About the topic, César Rodríguez confirmed that there is a list in which he himself and his team no longer have access to the Zarzuela Building. He considers that everything that is being done is illegal and unconstitutional. On the one hand, as the new Social Security law is in force on the conformation of the Board of Directors, in one of the transitory ones it leaves without effect any disposition that is contrary. For Cesar Rodriguez, the executive decree contradicts the law, so it is insubsistent. Additionally, he commented that María de los Ángeles Rodríguez has not been able to exercise his position because it is contested. The issue also moves from the Assembly. Assemblyman Luis Almeida, for his part, has sent communications to the authorities of the National Electoral Council, the Superintendence and the Constitutional Court, indicating that the law has already been approved, and that now it is up to the CNE to regulate the election process in 30 days.
