Sunat: more than 17,000 people must submit an electronic declaration of final beneficiary

The National Superintendence of Customs and Tax Administration (Sunat) reported that, between September 15 and 23, more than 17,000 taxpayers must comply with submitting the informative declaration of final beneficiary. With this provision, legal entities will inform the identity of their final beneficiaries.

The declaration is 100% virtual and is made through Virtual Form No. 3800, which has a simplified version available on the Sunat Online Operations (SOL) electronic platform found on its institutional portal.

On this occasion, the taxpayers who must file this declaration are the legal entities domiciled in the country that, in fiscal year 2021, registered net income greater than 500 UIT (S/ 2.2 million) up to 1,000 UIT (S/ 4.4 millions).

The final beneficiary is the natural person who owns shares or exercises control of a company, either directly or indirectly, individually or jointly with other natural or legal persons.

If it is not possible to fully identify it, it will be the natural person who occupies the highest or highest administrative position, Sunat explained.

“The rules of the final beneficiary are intended to prevent tax evasion and avoidance, guarantee compliance with the obligations of mutual administrative assistance in tax matters —exchange of information related to taxes and financial matters— and cooperate in the fight against money laundering. and financing of terrorism,” the institution specified in a statement.

It is important to indicate that, last June, legal entities domiciled in the country that, in fiscal year 2021, registered net income greater than 1,000 UIT (S/ 4.4 million) complied with presenting the declaration of final beneficiary.

  • In the event that the obligated taxpayer fails to file the return on time or enters incorrect information, a penalty proportional to their net income will be applied, which will range between 5 UIT (S/ 23,000) and 50 UIT (S/ 230,000).
